F. Peter Phillips has been a leader in the field of commercial dispute resolution for more than a decade. The areas below are indicative of his knowledge and experience in various substantive areas, including general commercial, insurance and reinsurance, franchise, employment, and cross-border disputes.
General Commercial Matters
Mr. Phillips has assisted groups of defendants in creating cooperation agreements and shared defense arrangements in complex environmental and mass claims proceedings. He has assisted in the design of early case assessment strategies for companies to facilitate and rationalize the treatment of streams of disputes. He has worked with the World Bank, the Harvard Corporate Social Responsibility Project and other organizations in studying how to establish systems for the early identification of conflict.

Insurance and Reinsurance Matters
As liaison to the CPR Insurance Committee for nine years, Mr. Phillips was responsible for mediation initiatives involving the property casualty industry, including representatives of AIG, CNA, Fireman’s Fund, QBE, Lloyd’s, AEGIS, Swiss Re, St. Paul Travelers, Hartford, and other companies. He was the principal drafter of the CPR Global Reinsurance Dispute Resolution Protocol, the mediation protocol for Construction Defect claims in Nevada, and the CPR Insurance Commitment for Claims Arising from September 11, 2001 Disaster. Mr. Phillips facilitated cooperative efforts among insurance companies to identify materials in immediate aftermath of a Providence, Rhode Island night club fire and among multiple insurers to manage cross-claims in a complex multiparty environmental claim in California. He continues to serve as the main convener and facilitator of insurers and re-insurers who meet periodically in Zurich, Switzerland, at the invitation of Swiss Re and the CPR Institute.

Franchise Matters
Mr. Phillips has spent several years as main liaison and administrator of the Franchise Mediation Program (www.FranchiseMediation.org). In that capacity Mr. Phillips has acquired the trust of many leading franchisees, franchisors and attorneys in the franchise community. He compiled the CPR publication Managing Franchise Relationships Through Mediation and was the principle drafter of revisions to the CPR Franchise Mediation Procedures. He also led a committee to draft Arbitration Rules for Franchise Disputes.

Employment Matters
Mr. Phillips administered the CPR Employment Committee for nine years and has written and spoken extensively on the management of employment disputes. He has testified before the EEOC in Washington, D.C. and is the general editor of two volumes on employment dispute management systems. He is very well-versed in the Due Process Protocol and has earned the trust of the leadership of both the employer and claimant bars.

Cross-Border Disputes
Perhaps no area of dispute resolution is more challenging than commercial conflicts between companies in different countries. Mr. Phillips’ work has been particularly prominent in this field: He has studied, written, spoken, and created protocols for commercial application in Africa, China, Hong Kong, Russia, Argentina, Costa Rica, and most of the countries of Europe. He is a member of the World Mediation Forum of the Union International des Avocats, and has spoken at annual meetings of the International Bar Association and the American Bar Association on dispute resolution in China and Europe. He has been active in devising conflict resolution projects for human rights claims and has developed a unique sensitivity to handling commercial conflicts involving Chinese companies.
