Annotated Code of Ethics for Arbitrators

Thanks to the indefatigable Paul Lurie for posting, on his arbitration/mediation Listserve, the news of the recent release of the Annotated Code of Arbitrator Ethics.

The Revised Code of Ethics for Arbitrators in Commercial Disputes was released in 2004 by the American Bar Association and the American Arbitration Association.  This newly released version of the Code provides citations to judicial decisions and other writings that cite the 2004 Code (or its 1977 predecessor) from 1981 through July 2010. 

These annotations lend highly valuable insight into the parameters of the Code’s various provisions and the fact settings that gave rise to their consideration in particular instances. 

This terrific work was prepared by a committee consisting of members of the Arbitration Committee of the ABA Section of Dispute Resolution, and the Ethics Committee of the College of Commercial Arbitrators.  Principally involved were:

Edna Sussman and Kurt L. Dettman, Co-Chairs, Arbitration Committee of the ABA Section of Dispute Resolution;

Robert A. Holtzman, Chair, Ethics Committee of the College of Commercial Arbitrators; and

David Brainin, Judith Meyer, Bruce Meyerson and Carroll Neeceman, Committee members and editors.

This 29-page document is packed with helpful information, and a must for practicing (and practical) commercial arbitrators.
